Kirk Koenig
Kirk Koenig has over twenty-five years of experience providing financial, economic, forensic accounting, and data analysis services.
His experience includes advising on wage and hour litigation and compliance, complex business interruption and liability insurance claims, claims for lost profits and damages, fraud investigations, and other commercial disputes.
Mr. Koenig has applied economic, statistical, and complex data analyses to address questions of damages and class certification in numerous wage and hour matters. His experience includes claims brought pursuant to the Fair Labor Standards Act (FLSA) and state and municipal labor codes, as well as internal assessments of potential exposure to wage and hour claims. He has analyzed claims for off-the-clock work, improper calculation of the regular rate of pay, time shaving, improper time rounding, improper tip pooling, FLSA “gap time” pay, employee misclassification, prevailing wage claims, and derivative penalties including penalties alleged under the California Private Attorneys General Act (PAGA).
Mr. Koenig’s practice also includes extensive case work involving billions of dollars in insurance claims. He has prepared and presented first-party insurance claims for business interruption, extra expense, and property damage, including claims stemming from hurricanes and other major weather events, construction defects, environmental contamination, product recalls, and other major loss events. He has prepared claims and analyzed insurance recovery for environmental, asbestos premises and products, construction products, repetitive stress injuries, deleterious substances, and other liability insurance exposures.
Mr. Koenig has been engaged by clients in a variety of industries, including automotive, banking, chemicals, construction, consumer products, energy/utilities, e-commerce, financial services, food and beverage, healthcare, higher education, manufacturing, professional services, restaurant, retail sales, telecommunications, and transportation. He has provided expert testimony and other litigation support services in arbitration, mediation, settlement conferences, and state and federal court proceedings.
