James Toal is a director with BRG’s Energy & Climate practice in Houston. He has testified in federal and state court while providing consulting services to clients around the world. He is a CFA (Chartered Financial Analyst) charterholder.

Mr. Toal has worked on engagements including:

  • Conducted solvency analysis related to alleged fraudulent transfers made by real estate development company; issued expert report and testified in bankruptcy court summarizing analysis and conclusions.
  • Evaluated and rebutted a claim for lost profits related to alleged infringement of trademarks utilized for sale of waterline cleaning and hygiene market products in agricultural industry; issued expert report.
  • Served as neutral financial advisor in dispute over division of estate that included ownership of irrigation and landscaping company; performed valuation of company to assist with settlement of dispute.
  • Performed valuation of oil and gas field for dispute related to certain alleged breaches of Energy Charter Treaty Agreement and investment treaty between Azerbaijan and country of claimant.
  • Conducted valuation of vertically integrated, private oil and gas company for purposes of a divorce proceeding; analyzed company’s operations and impact of recent market events on it; assisted counsel with in-depth mediation proceedings and related negotiations.
  • Assessed damages in an international arbitration proceeding between German Landesbanks and Country of Spain regarding remuneration changes with respect to solar photovoltaic projects.
  • Performed solvency analysis and financial investigations relating to large hotel chain in bankruptcy; worked as financial advisor to court-appointed examiner to conduct financial analyses relating to $8 billion purchase price for hotel chain and commercial mortgage-backed security loan structure.
  • Assessed economic damages related to alleged unfair competition and misappropriation of trade secrets by two companies competing in commercial meat and cheese slicing industry.
  • Assessed trademark infringement damages claimed by well-known personal injury lawyer related to advertisements placed by marketing agency on search engine platforms; rebutted damages put forward by opposing expert who utilized various statistical methods.
  • Evaluated economic damages related to alleged infringement of patents by technology and consumer products company that provides electronic and communications systems to commercial and private aviation companies.
  • Conducted valuation of intellectual property (IP) assets of renowned music and cultural venue; valuation utilized to transfer IP and non-IP assets among company’s owners.
  • Evaluated economic damages related to antitrust conspiracy by leading hotel chains against online travel agency; calculated damages related to lost value and lost profits as result of inventory cutoffs and disruptions; rebutted damages related to trademark infringement claim made by the hotel chains.
  • Evaluated damages suffered by oil and gas waste services company resulting from alleged misrepresentations, omissions, and breaches of contract made in a transaction; determined value of company as represented by seller and as actually received.
  • Analyzed liquidity situation of international photography processing company that filed for bankruptcy six months after being sold to an investor; performed cash-flow modeling to determine going-concern status of company at closing.
  • Performed financial investigations relating to the bankruptcy of large international investment bank; analyzed sale of bank’s North American operations and bank’s trading portfolio; identified valuation errors in internal valuation of bank’s trading portfolio and acquirer’s valuation of trading portfolio.
  • Worked in multidisciplinary team that managed insurance and Federal Emergency Management Agency (FEMA) claims process for state and local government entities affected by Hurricane Katrina; corresponded with FEMA and local government officials to establish individualized recovery system for state school system; prepared analyses that were presented to top national government officials, including a funding analysis presented to officials in Washington, DC.
