James A. Falconi

Director

James Falconi has provided consulting services in areas such as commercial damage claims, construction claims, bankruptcy litigation, lost profits damages, business interruption claims, fraud investigations, accounting malpractice and directors’ and officers’ liability investigations, and general fact-finding and analysis regarding economic and financial issues.

He has testified to his findings and opinions in state and federal court, as well as mediation and informal negotiation sessions. He has also served as a federal court-appointed special master.

Commercial Damages

Mr. Falconi has advised clients in many matters involving damage claims measured by lost business opportunities and/or increased costs resulting from alleged breaches of contract, breaches of warranty, and professional malpractice.

Construction

Mr. Falconi has performed construction contract reviews in connection with significant construction projects. These projects involved a variety of aspects of construction, ranging from civil subcontractor work to mechanical and electrical subcontractors. In connection with many of these projects, he also evaluated the validity of related construction claims involving increased cost and delay damages.

Financial Services

Mr. Falconi has encountered various issues within the context of the financial services industry. He has provided advice to the Resolution Trust Corporation, Federal Deposit Insurance Corporation, National Credit Union Association, insurance companies, and insureds involving special purpose reviews, forensic accounting analyses, accounting malpractice, director and officer liability, and fidelity bond investigations, as well as insurance claim preparation and analysis. He has also provided advice in bankruptcy matters involving failed financial services companies.

Industry Exposure

Mr. Falconi has spent twenty-two years providing forensic accounting services to clients in a wide variety of industries. Prior to his career as a forensic accountant, he served as the controller of a manufacturer of metal products. Before his controller position, he worked in public accounting with both international and regional firms. He planned and supervised audits of large international corporations as well as small, closely held companies. In his thirty years in consulting and accounting, he has been exposed to a wide variety of industries including manufacturing, construction, mining, banking, insurance underwriting/brokering, healthcare, governmental agencies, nonprofit institutions, law firms, advertising/promotions, real estate development/management, pharmaceuticals, and retailing.
