On December 3, Chris Goncalves participated in the panel “Causation in Investor-State Dispute Settlement [ISDS] Arbitration,” which explored interpretations of causation in international law and examine the applicability of the “but-for” causation standard, the two-tiered framework of factual and legal causation, and relevant standards of proof.

On December 6, Alayna Tria took part in the panel “International Arbitration in the Era of Climate Crisis,” which reviewed the UN Climate Change Conference, or Conference of the Parties (COP 28); oil and gas decommissioning; the upcoming International Court of Justice advisory opinion on climate change; and the proposed establishment of a fund to compensate environmental damages.
