Tom O’Neil moderated a comprehensive session on “Ramifications of an Enforcement Action for an Organization” at the Health Care Compliance Association (HCCA) Healthcare Enforcement Compliance Conference.

He was joined by panelists David Fuchs (Office of Inspector General (OIG)) and John Scott (Centers for Medicare & Medicaid Services (CMS)) to discuss topics including:

  • best practices for successfully navigating agency enforcement actions and restoring trust with stakeholders including federal and state agencies and beneficiaries of government-sponsored healthcare programs
  • differentiating between corporate integrity agreements (CIAs), systems improvement agreements (SIAs), and intermediate sanctions to better understand possible ramifications of each
  • how to navigate enforcement negotiations when both OIG and CMS are involved
  • processes for remediating compliance and operational deficiencies that resulted in the imposition of a CIA, an SIA, and/or intermediate sanctions
  • the importance of organizational values and culture
  • how to effectively leverage CIA and SIA obligations, even after those agreements have terminated, to create scalable and sustainable compliance and ethics and quality of care programs
